Key Architecture Notice: Zero-Data Retention
OBJify operates on a strict, privacy-first Zero-Data Retention Architecture. We do not archive or store your uploaded photos or resulting 3D models. Files exist temporarily on our servers only during generation and are permanently purged immediately upon download, session reset, or after 1 hour. You are solely responsible for saving and archiving your downloaded files.
1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and OBJify (“OBJify”, “we”, “us”, or “our”), governing your access to and use of the OBJify web application, AI-powered image-to-3D generation pipelines, and associated software services (collectively, the “Service”).
By accessing, authenticating via magic link, uploading images, or purchasing credit packs, you explicitly acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of the Service.
2. Zero-Retention Architecture & User Archival Duty
OBJify is engineered specifically to eliminate data hoarding and protect creator confidentiality:
- Ephemeral Processing: Uploaded source images, intermediate neural background cutouts, and generated 3D files (
.obj,.mtl, textures,.glb,.stl) are stored temporarily in volatile server cache exclusively for the duration necessary to execute generation and interactive inspection. - Immediate Server Deletion: All server-side copies of your uploaded photos and generated 3D models are permanently destroyed and deleted from disk immediately upon initial file download or when you click “Start Over” / “Reset”. Any abandoned session is purged automatically within 1 hour.
- Client-Side Memory Hand-off: Upon download, the 3D model is transferred directly into your local browser cache (in-memory Blob). Repeated clicks on the download button deliver the file from your local computer's memory, not our servers.
- Strict No-Hosting & User Backup Obligation: OBJify does not provide cloud file storage or historical file retrieval. Once an output is downloaded or a session is cleared, it cannot be recovered by OBJify staff or backup systems. You bear sole responsibility for preserving and backing up your generated assets immediately upon download.
3. Intellectual Property & Commercial Rights
Your Input Images: You retain all preexisting ownership, copyright, and intellectual property rights in and to the images you submit to the Service. You grant OBJify only a limited, revocable, non-exclusive, worldwide, royalty-free license strictly to process the image through our neural pipeline to deliver the 3D model to you.
No AI Model Training on User Data: We explicitly covenant that we do NOT train, fine-tune, or improve any public or proprietary machine learning or AI models on your uploaded images or resulting 3D models.
Ownership of Generated 3D Models: To the fullest extent permissible by applicable law, OBJify assigns to you all right, title, and interest in and to the 3D meshes, textures, and export packages generated from your inputs. You receive full, worldwide commercial usage rights to use, reproduce, modify, 3D print, sell, or integrate the outputs into video games, animations, physical merchandise, and commercial software without royalty obligations to OBJify.
User Warranty: You represent and warrant that you own or have obtained all necessary licenses, permissions, and rights to submit the uploaded imagery, and that your uploads do not infringe the copyright, trademark, trade secret, or privacy rights of any third party.
4. Acceptable Use Policy (AUP)
You agree not to upload, generate, or distribute any content that:
- Contains Child Sexual Abuse Material (CSAM) or sexually explicit depictions of minors (reported immediately to NCMEC and law enforcement).
- Depicts functional firearms, explosive devices, weapon blueprints, or illegal contraband designed to cause physical harm.
- Infringes trademarked character designs, brand logos, or patented physical products without authorization from the rightsholder.
- Contains non-consensual intimate imagery, hate speech, or terroristic propaganda.
- Attempts to probe, scan, reverse-engineer, exploit, or launch Denial-of-Service (DoS) attacks against our infrastructure or GPUs.
5. Consumable Credits, Payments & Strict No-Refund Policy
Credits Are Consumable Digital Items: Access to 3D model downloads and high-resolution mesh packages is billed via prepaid digital utility credits (“Credits”). Credits are single-use consumable digital items provisioned immediately into your account balance upon payment confirmation. Credits have no cash value outside the Service, are non-transferable, and do not accrue interest.
Credit Non-Expiration Policy: Purchased Credits do not expire on a monthly, annual, or inactivity basis and remain valid in your account balance indefinitely for the operational lifetime of the Service. The sole exception is in the event that OBJify permanently terminates, discontinues, or shuts down the Service. Should the Service be permanently discontinued, all remaining unconsumed credits will expire and terminate upon the effective date of closure, without cash value, refund, or financial liability.
Strict No-Refund Policy (All Sales Are Final): Because neural 3D synthesis expends immediate, irreversible GPU computational time, electricity, and high-performance server resources, ALL PURCHASES OF CREDITS ARE STRICTLY FINAL AND NON-REFUNDABLE. No refunds, cash returns, or store reversals will be issued under any circumstances, whether for consumed credits, partially consumed packs, or remaining unconsumed credit balances.
Statutory Waiver of Right of Withdrawal (EU / UK / International): By purchasing Credits, you expressly request and consent to the immediate performance of this contract and the immediate digital provisioning of the Credits to your account balance. In accordance with Article 16(m) of EU Directive 2011/83/EU on Consumer Rights and equivalent statutory consumer regulations worldwide, you acknowledge and agree that you expressly waive any statutory 14-day right of withdrawal, cooling-off period, or cancellation right once the digital consumables have been credited to your account.
No Chargebacks: You agree not to file unjustified chargebacks or payment disputes with your bank, credit card issuer, or payment processor (e.g., Stripe). Attempting to circumvent this No-Refund Policy through fraudulent or unauthorized chargebacks constitutes a material breach of these Terms and will result in the immediate termination of your account, forfeiture of all remaining credits, and potential legal remedies to recover dispute costs.
Technical Fail-Safe (Credit Restoration Only, Never Cash): In the event that a generation job encounters an unexpected server error, GPU crash, or technical pipeline fault prior to delivering a downloadable mesh, that credit is automatically restored to your in-app credit balance. This fail-safe operates strictly as an in-app credit re-crediting mechanism and never as a monetary or cash refund.
6. We Cannot Guarantee Anything: AI Disclaimers & “As-Is” Warranty
Experimental AI Nature & No Guarantees: Neural 3D synthesis algorithms are non-deterministic, synthetic, and experimental. OBJify CANNOT AND DOES NOT GUARANTEE ANYTHING REGARDING THE ACCURACY, QUALITY, AESTHETICS, SUITABILITY, OR PHYSICAL REPRODUCIBILITY OF GENERATED ASSETS. Generated meshes may contain geometric artifacts, non-manifold edges, self-intersecting faces, holes, inverted surface normals, simplified topology, or interpretive texture variations.
Free Upfront Inspection: To guarantee total transparency before you consume any Credits, OBJify provides a 100% free interactive 360° turntable preview. You are solely responsible for inspecting this preview to determine whether the visual reconstruction meets your expectations before deciding to spend a credit to unlock the production download.
Subjective Dissatisfaction: Subjective dissatisfaction with the artistic style, topological density, geometric likeness, or texture interpretation of an AI-generated model does NOT entitle you to a refund, credit recharge, or replacement.
THE SERVICE AND ALL GENERATED 3D ASSETS ARE PROVIDED ON A STRICT “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE (SUCH AS PRECISION 3D PRINTING, STRUCTURAL ENGINEERING, OR MANUFACTURING TOLERANCES), OR NON-INFRINGEMENT.
7. Limitation of Liability & Indemnification
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OBJify, ITS DIRECTORS, EMPLOYEES, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA LOSS, CORRUPTION OF LOCALLY STORED FILES, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OBJify'S AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS SHALL UNDER NO CIRCUMSTANCES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO OBJify IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY EUROS (€50.00).
You agree to indemnify, defend, and hold harmless OBJify and its officers against any third-party claims, liabilities, damages, and expenses (including reasonable attorney fees) arising from your breach of these Terms or your infringement of third-party intellectual property.
8. Account Termination & Service Discontinuation
We reserve the right to suspend or terminate your account and revoke access to the Service without prior notice if you violate these Terms, engage in fraudulent chargebacks, or abuse computing resources. Users may delete their account at any time via the user profile or by contacting support.
OBJify reserves the right to modify, suspend, or permanently discontinue the Service (or any portion thereof) at any time. In the event of a permanent shutdown of the Service, we will make reasonable efforts to provide advance notice where practicable, and any remaining unconsumed Credits will expire upon the effective shutdown date without monetary compensation or refund.
9. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the European Union and Spain, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall first be submitted to good-faith informal negotiation for a minimum of 30 days before initiating judicial proceedings.
